Terms and Conditions of Sale
1. All purchasers/buyers/bidders are required
to obtain a bid number to bid -- registering with Bill Payne Auctions, inc.,
hereinafter referred to as BPA, by providing correct name, current address,
phone number, and/or other means of positive identification deemed necessary
by BPA.
2. When bidding, be obvious and absolutely
sure you have the attention of the auctioneer to avoid confusion. If any
dispute arises between bidders, the decision of the auctioneer shall be
final. If any post-auction dispute arises, records of sale including but
not limited to video, audio, and/or clerking sheets will be conclusive.
3. Please show your bid number to auction clerk
after each purchase to insure accurate recordation and to eliminate possible
error.
4. BPA and its auctioneers reserve the right
to: reject any and all bids; decline any and/or all bids made by persons
who have defaulted in former purchases or by persons who in their judgment
are not responsible bidders; bid on behalf of sellers and buyers; withdraw
any property before or at the time of sale and shall have no liability
whatsoever for such withdrawal.
5. NOTICE -- With all of their defects and imperfections,
auction lots are offered and sold "as is" without any representations or
warranties. Examination of merchandise is allowed prior to & during
auction. Bidders/purchasers are encouraged to use this time to personally
inspect the condition of all property offered for sale to their satisfaction
-- prior to bidding!! BPA strives diligently to examine and announce known
defects of property offered however, the absence of any such announcement
or reference to the condition of property does not imply that it is without
defects, repairs or restorations. Some auction property, in the course
of its normal lifetime, may incorporate parts not original to it. No return
of merchandise is allowed unless such guarantee is specifically announced
by BPA at the time of sale. Acting as commission agent only, BPA assumes
no liability for seller's guarantee be it expressed or implied nor shall
BPA be responsible for the actions of its principals.
6. Purchasers assume complete responsibility
for their merchandise and are strongly advised to immediately safeguard
their purchases at the time auctioneer declares the item(s) sold !!
7. SETTLEMENT OF PURCHASES: Complete payment
in full is required on day of auction with no merchandise being removed
from auction site before settlement. Cash, or good check w/positive identification
is acceptable.
VISA and MasterCard (w/fee) A return check fee of $25.00 will be charged by BPA for
any purchaser's check returned for whatever reason.
8. All persons attending viewings, auction,
or in the act of loading or removing purchases assume all risks and liabilities
of damage and/or loss to persons and/or property and specifically release
BPA, its employees, representatives, etc., from any liability thereof.
9. Additional terms and conditions of sale
may be posted and/or announced at the time of sale and are hereby incorporated
by reference and made a part hereof as though fully set forth herein.
10. All bidders, spectators, and others attending
and/or participating in this auction acknowlege that they have read, fully
understand, and agree to abide by these terms and conditions of sale. Persons
unwilling to agree to abide by these terms and conditions of sale, are
respectfully requested to return their bid number to cashier.
Please keep your bidder's card in your possession
at all times during the auction --- by registering and obtaining it, you
